2. Applicability

These Terms of Use (ToU) apply when you create an account and engage with reviews and comments on our Artinforms.store. Our Artinforms.store is hosted by Woocommerce, providing the online e-commerce platform that enables us to sell products and services to you.

 

 

3. Your Customer Account

3.1 In our Artinforms.store, you can purchase products as a guest or by creating a customer account. Having a customer account eliminates the need to enter your personal data with each purchase; instead, you can log in using your email address and password before or during the order process.

3.2 Registering for a customer account does not obligate you to purchase any of our offered products.

3.3 You have the option to delete your customer account at any time.

4. Reviews and comment

4.1 You may post reviews and comments (“content”) as long as the content is not obscene, abusive, threatening, defamatory, invasive of privacy, infringing intellectual property rights, constitute a communicative attack against children/adolescents, impair the personal integrity of children/adolescents, or otherwise injurious to third parties or objectionable and does not consist of or contain software viruses, political campaigning, commercial solicitation, chain letters or any form of “spam” or is otherwise considered illegal under applicable law. You may not use a false e-mail address, impersonate any person or entity, or otherwise use misleading information.

4.2 If you believe that a certain content violates these ToU or is illegal under applicable law, you may report it to our support email (info@artinforms.store). We review content proactively with moderators and re actively e.g. following a report by users or authorities through the support email. We may remove content or restrict access to your account, if we reasonably believe that it violates these ToU, is illegal under applicable law or causes harm to us, or our users or other third parties. In addition to considering the violation at hand when making such decisions, we also consider your historical use of Artinforms.store and whether you have repeatedly violated our ToU.

4.3 Whenever we remove content or restrict the use of your account or decide to keep the content live despite your report, we will notify you and state the reasons for our decision.

5. Changes to our Terms of Use

We reserve the right to modify our Terms of Use, particularly to make reasonable technical adjustments to our services and ensure ongoing operability. We will inform you of any changes.

6. Applicable Law and Jurisdiction

The laws of the Federal Republic of Germany govern these Terms of Use. If you are a consumer and have your habitual residence in the EU, you also benefit from the mandatory provisions of the law of your country of residence. The application of the United Nations Convention on Contracts for the International Sale of Goods (CISG) is explicitly excluded.

A. Terms of Sale

These Terms of Service (ToS) apply to any purchase made from Artinforms through our Store, which can be accessed at https://www.artinforms.store. Artinforms is the seller and your contractual partner for these transactions. Please read these ToS thoroughly before making a purchase. By placing an order, you agree to these ToS. All information and contractual details on our Store are provided in English.

2. Conclusion of Purchase Contract and Correction of Input Errors

2.1 The product presentations in our Store serve as an invitation to place orders rather than a legally binding offer.

2.2 To place an order, first add the desired products to your shopping cart by clicking “Add to cart.” After adding products to the cart, clicking the “Checkout” button will take you to a page where you can enter your personal details. By clicking the “Continue to shipping” button, you will be able to select your preferred shipping and payment methods. Alternatively, express checkout methods are available. You will have the opportunity to review your information and correct any input errors (such as payment method, personal data, or quantity) before submitting your order.

2.3 By clicking the “Pay now” button, you submit a binding purchase offer for the items in your cart. After submitting your order, you will receive an order confirmation summarizing your purchase. This confirmation does not signify acceptance of your contract offer; it simply acknowledges receipt of your order. The purchase contract is finalized once we ship the ordered products to you and confirm this with a shipping confirmation email. You can cancel your order at any time before receiving the shipping confirmation email, regardless of your statutory right to withdraw from the contract.

2.4 You will receive these ToS, along with information on your statutory right of withdrawal and the details of your order, in the order confirmation email.

2.5 All products remain our property until full payment is received.

3. Electronic Gift Cards

3.1 You can purchase and redeem electronic gift cards (“Gift Cards”) in accordance with our Terms of Service. These Gift Cards are valid and redeemable exclusively in our EU Shop.

3.2 Gift Cards are delivered to you via email. Once the email has arrived on your mail server, you cannot cancel your Gift Card order, although your right of withdrawal remains unaffected. You can access the Gift Card amount and code by clicking on the link in the email. To redeem your Gift Card during a purchase in our Shop, you must enter the electronic code at the end of the checkout process.

3.3 The credit amount of a Gift Card is expressed in EUR and does not accrue interest. If the Gift Card amount is insufficient for your order, the balance can be paid using any other payment methods we offer. Partial redemption of the Gift Card is possible, with any remaining value retained on the Gift Card.

3.4 If you purchase products using a Gift Card and subsequently withdraw from or cancel the purchase, any amount paid using the Gift Card will be returned to the Gift Card balance. Cash redemption is not possible.

3.5 Gift Cards may not be copied, edited, or manipulated. We do not assume liability for any errors in the email address provided for the Gift Card delivery and cannot replace the voucher. The risk of loss and title for Gift Cards passes to the purchaser upon our electronic transmission of the Gift Card. The Gift Card is transferable.

4. Right to Withdraw and Product Warranty

4.1 As a consumer, you are entitled to withdraw from the contract within 14 days, in accordance with the provisions described below.

4.2 In accordance with applicable statutory provisions, Artinforms is liable for defective products. Customers in the EU can exercise their warranty rights for up to 2 years after delivery of the products, and can request repair or replacement if the products are defective or otherwise differ from their description. Any claims due to defects maliciously concealed by us will expire after the statutory limitation period. If the products cannot be repaired or replaced within a reasonable period of time, you can request a refund of the purchase price.

4.3 In addition to your statutory rights, we offer a refund or replacement for products for up to 3 months after the delivery date under our voluntary return policy. To qualify for a refund or replacement, the products must be returned clean, unwashed, and, where applicable, in their original packaging. Please note that shipping fees are non-refundable in this case.

INFORMATION ON THE RIGHT OF WITHDRAWAL

A. Right of Withdrawal

You have the right to withdraw from this contract within 14 days without providing any reason.

The withdrawal period will expire 14 days after the day you, or a third party indicated by you (other than the carrier), acquire physical possession of the goods.

For contracts involving multiple goods ordered in one order and delivered separately, the withdrawal period will begin on the day you, or a third party indicated by you (other than the carrier), acquire physical possession of the last item.

To exercise the right of withdrawal, you must inform us of your decision to withdraw from the contract through an unequivocal statement (e.g., a letter sent by post, fax, or e-mail) to the following address:

You may use the attached model withdrawal form, but it is not mandatory.

To meet the withdrawal deadline, it is sufficient to send your communication regarding your exercise of the right of withdrawal before the withdrawal period expires.

B. Effects of Withdrawal

If you withdraw from this contract, we will reimburse all payments received from you, including the costs of delivery (except for any additional costs arising if you chose a delivery method other than the least expensive standard delivery offered by us), without undue delay and no later than 14 days from the day we are informed of your decision to withdraw from this contract. The reimbursement will be made using the same payment method as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement. We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent the goods back, whichever is earlier.

You must send back the goods without undue delay and no later than 14 days from the day you communicate your withdrawal from this contract to us. The deadline is met if you send back the goods before the period of 14 days has expired. In some cases, you may not need to return the goods. For more information, please contact our customer service. If you contact our customer service within your withdrawal period, the aforementioned deadline for returning the goods begins only from the time our customer service provides you with information about the obligation to return the goods.

You will have to bear the direct costs of returning the goods.

You are only liable for any diminished value of the goods resulting from handling other than what is necessary to establish the nature, characteristics, and functioning of the goods.

5. Payment terms

All prices displayed in our Store include the applicable VAT, but are net of shipping costs. The purchase price is due immediately after the contract is Store.

6. Shipping of Products

6.1 If no specific delivery time is indicated in our Store, we aim to deliver within 2-6 business days within the EU and within 8-10 business days outside the EU. Partial orders cannot be shipped. Orders containing pre-ordered items will be shipped once all items are available.

6.2 Additional shipping costs are itemized separately in your shopping cart. If a selected product is unavailable at the time of your order, we will notify you accordingly. If the product is permanently unavailable, you will not receive a shipping confirmation email, and any payments made will be refunded.

6.3 For deliveries outside the EU, please note that you may be subject to import duties and taxes upon arrival at your destination. Any additional charges for customs clearance are your responsibility as the importer of record. We have no control over these charges. Additionally, you are required to comply with all laws and regulations of the destination country when ordering from us.

7. Liability

We are responsible for damages resulting from intentional or grossly negligent conduct. Additionally, we are liable for negligently breaching obligations crucial for fulfilling the purchase contract, obligations whose breach could jeopardize the contract’s purpose, and obligations upon which you, as a customer, typically rely. In such cases, our liability is limited to foreseeable and typical contractual damages. This liability extends to breaches of duty by our representatives. Exemptions from liability do not apply in cases of harm to life, body, or health. Liability under product liability law remains unaffected.

10. Online and alternative dispute resolution

  1. The European Commission provides a platform for online dispute resolution under http://ec.europa.eu/consumers/odr/.
  2. We are not obligated and not willing to participate in dispute resolution proceedings pursuant to the German Consumer Dispute Resolution Act (VSBG).

11. Applicable law and jurisdiction

The law of the Federal Republic of Germany shall apply. If you are a consumer and have your habitual residence in the EU, you additionally enjoy the protection afforded to you by mandatory provisions of the law of your country of residence. The application of the United Nations Convention of Contracts for the International Sale of Goods (CISG) is expressly excluded.

12. Severability clause

In case individual provisions of this contract are invalid, this shall not affect the validity of this contract as a whole.
